Terms and Conditions — SafeShift Logistics Pvt. Ltd.

1. Introduction
These Terms and Conditions (“Terms”) govern the use of logistics, transportation, and related services provided by SafeShift Logistics Pvt. Ltd. (“SafeShift”, “Company”, “we”, “our”, or “us”). By booking a shipment, accessing our website, or engaging any of our services, you confirm that you have read and agree to be bound by these Terms.

2. Scope of Services
SafeShift Logistics Pvt. Ltd. provides freight forwarding, transportation, pickup and delivery, supply chain support, packers and movers, relocation, and removal services for individuals and businesses across Bihar and Jharkhand.
The specific nature of each engagement — including delivery timelines, service levels, pricing, and operational terms — will be set out in the relevant service agreement, quotation, invoice, or booking confirmation issued to the client. SafeShift reserves the right to modify, suspend, or update its service offerings at any time to maintain operational and regulatory compliance.

3. Client Responsibilities
Clients engaging SafeShift services are required to:
- Provide accurate and complete shipment information, including correct sender and receiver details.
- Ensure all shipments comply with applicable laws, customs regulations, and transportation guidelines.
- Pack, label, and secure goods adequately to prevent damage during transit.
- Confirm that goods are legal, safe, and suitable for transportation.
- Settle all applicable service charges, duties, and fees within the agreed payment period.
SafeShift shall not be liable for delays, damages, or regulatory actions resulting from inaccurate information or inadequate packaging supplied by the client.
4. Prohibited and Restricted Shipments
Clients must not tender for shipment any goods that are prohibited, illegal, or classified as unsafe under Indian law or company policy. Prohibited items include but are not limited to:
- Explosives, ammunition, firearms, or weapons of any kind
- Hazardous, radioactive, or toxic materials
- Flammable chemicals or substances
- Illegal drugs or narcotics
- Counterfeit goods or items subject to import/export restriction
- Precious metals, currency, or high-value items unless declared and approved in advance
- Perishable goods without appropriate packaging and prior declaration
For guidance on what qualifies as a restricted item under Indian transport law, refer to the Ministry of Road Transport and Highways. SafeShift reserves the right to inspect any shipment and to refuse, hold, confiscate, or report prohibited goods to the relevant authorities without prior notice.
5. Shipment Packaging and Risk
The client bears full responsibility for ensuring goods are packaged to a standard appropriate for road transportation. SafeShift shall not be held liable for damage attributable to:
- Inadequate or improper packaging by the client
- Fragile items dispatched without sufficient protective materials
- Internal damage caused by the inherent nature of the goods
Where required, clients may request supplementary packaging or insurance services, subject to availability and additional charges.
6. Pricing and Payment Terms
Service charges are calculated on the basis of weight, volume, distance, service tier, and operational requirements at the time of booking. Payment must be made in accordance with the terms set out in the applicable invoice, service agreement, or booking confirmation.
SafeShift reserves the right to:
- Suspend or withhold shipments where payment is outstanding
- Apply late payment charges or penalties as specified in the service agreement
- Pursue outstanding dues through lawful collection procedures
All quoted prices are exclusive of applicable taxes unless expressly stated otherwise. Tax obligations are governed by the Goods and Services Tax framework as administered by the Government of India.
7. Delivery and Transit Time
All delivery timelines communicated by SafeShift are estimates and should be treated as indicative. While we take all reasonable steps to meet committed timelines, SafeShift shall not be held responsible for delays arising from:
- Adverse weather conditions
- Traffic disruptions or road closures
- Government restrictions or inspections
- Customs clearance procedures
- Natural disasters or unforeseen operational disruptions
8. Limitation of Liability
To the fullest extent permitted under applicable Indian law, SafeShift Logistics Pvt. Ltd. shall not be liable for indirect, incidental, consequential, or special damages of any nature, including loss of business, loss of profits, loss of data, or business interruption.
In all cases, the maximum liability of SafeShift in connection with any specific shipment shall not exceed the service charges paid by the client for that shipment, unless additional insurance has been explicitly purchased and confirmed in writing prior to dispatch.
9. Insurance
Unless agreed otherwise in writing, shipments carried by SafeShift are not automatically insured. Clients who require coverage must request shipment insurance prior to dispatch, at additional cost. All insurance claims are subject to the terms and conditions of the relevant insurance provider.
Clients are encouraged to review their existing commercial or personal insurance arrangements. The Insurance Regulatory and Development Authority of India (IRDAI) provides guidance on goods-in-transit coverage options available in India.
10. Force Majeure
SafeShift shall not be held responsible for any failure, delay, or disruption in service delivery caused by circumstances beyond its reasonable control. This includes but is not limited to natural disasters, floods, earthquakes, fire, war, civil unrest, government actions, labour strikes, transport shutdowns, or public health emergencies.
In such circumstances, SafeShift will make all reasonable efforts to resume normal operations at the earliest opportunity and will communicate material disruptions to affected clients.
11. Indemnification
The client agrees to indemnify and hold harmless SafeShift Logistics Pvt. Ltd., including its directors, employees, agents, and affiliates, against any claims, damages, losses, liabilities, or expenses arising from:
- Violation of these Terms by the client
- Tendering prohibited or illegal goods for shipment
- Breach of any applicable law or regulation
- Improper packaging or inaccurate shipment declarations
12. Suspension or Termination of Services
SafeShift reserves the right to suspend, restrict, or terminate services to any client without prior notice where:
- The client has violated these Terms
- Payment obligations remain unfulfilled
- A shipment presents legal, safety, or operational risk
Termination of services does not extinguish any outstanding obligations, payment dues, or liabilities incurred prior to termination.
13. Governing Law and Jurisdiction
These Terms are governed by and shall be construed in accordance with the laws of India. Any dispute arising from or relating to these Terms or SafeShift’s services shall be subject to the exclusive jurisdiction of the courts located in Jamshedpur, Jharkhand.
14. Amendments to Terms
SafeShift reserves the right to revise or update these Terms at any time. The most current version will be published on this page with a revised effective date. Continued use of our services following any such update constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
